Claims history statement – Useful information


B AAR issues, upon request, a claims history statement, a document containing information on the claims registered during the last 5 years of insurance or the absence of these claims. The statement is issued in Romanian and English and might be useful for the people that want to contract MTPL insurances in other countries

1. How to obtain the claims history statement. Required documents:

    • a complete claim, that can be downloaded HERE.
    • a copy of the identity card
    • for natural persons wishing to receive the certificate in other country than Romania – proof of residence at the address where the claims history statement is to be mailed (only for Romanian citizens residing abroad)
    • for natural persons empowered to receive the certificate in the name and for the holder – original authenticated mandate sealed by a public notary
    • for legal persons letter of attorney stating the name and identification details of the person designated to apply for and/or to receive the certificate, respectively a valid document issued by a Romanian authority (e.g.: National Trade Register Office) stating the statute as legal representative of the legal person for the signatory of the letter of attorney

2. Methods of documents’ submission for obtaining the claims history statement:

    • by e-mail at certificat@aida.info.ro
    • by mail at BAAR headquarters (postal address: Bucuresti, sector 2, strada Vasile Lascar, nr. 40-40Bis, etaj 5)
    • by personal deposit at BAAR headquarters (address: Bucuresti, sector 2, strada Vasile Lascar, nr. 40-40Bis, etaj 5)

Attention!!! Documents sent to another email address belonging to BAAR will not be considered

3. Deadline for issuance of the claims history statement

    • the certificate will be issued within 15 days calculated from the submitting a complete application, i.e. a correct claim accompanied by all the necessary documents mentioned above

4. Ways of getting possession of the claims history statement

    • personal pick-up by the bearer or by the person presenting an authenticated mandate (sealed by a public notary) from the BAAR headquarters (address: Bucuresti, sector 2, strada Vasile Lascar, nr. 40-40Bis, etaj 5)
    • personal reception from the Romanian Post Office services at the address stated within the Romanian identity card
    • personal reception from the Romanian Post Office services at the address stated within the foreign residence document 

IMPORTANT:

    • the certificate cannot be sent by email except to the natural persons (individuals) and only if the conditions mentioned below are met
    • the certificate cannot be sent by post to other addresses, declared on their own by the applicant

Claims history statement validation

    • the statement is issued without stamp and without signature but with registration number and validation code
    • validation is done through a unique security code printed on each issued statement – using this code the claims history statement can be validated at a dedicated web address (mentioned in the certificate)


CONDITIONS TO BE MET IN ORDER TO RECEIVE THE CLAIMS HISTORY STATEMENT BY EMAIL (available only for the natural persons)

In order to receive the statement by email, the following document must be attached to the application (containing the claim and the other documents mentioned above):

  • a statement, signed on own responsibility, drawn in Romanian or the official language of the state of residence (only in one of the official EU languages):
    • (i) authenticated by a public notary, diplomatic mission or consular office of Romania in the country of residence, as the case may be, and
    • (ii) whose content, signature and date are attested by a lawyer, if this one has, according to the law of the country of residence, attributions in this respect

The statement will be sent by email to certificat@aida.info.ro (together with the other documents mentioned above).

The statement should mention the following:

  • the identity of the person requesting the claims history statement (name and surname, Romanian personal identification number, home address and residence address (for natural persons residing abroad));
  • the declared mobile phone number, of the person requesting the claims history statement, on which he/she will be contacted by BAAR representatives
  • the declared email address, of the person requesting the claims history statement, to which BAAR will send the claims history statement
  • the professional identification data of the public notary or the lawyer (these must be found in the authentication / attestation)

Attention!!! The claims history statement will be sent to the applicant via the declared email address in a password protected file and the password will be communicated on the declared telephone number.



About the claims history statement

According to the provisions of Law no. 132/2017, art. 18, par. (10): “The MTPL insurer shall, within 15 days of registration of the request, issue to the insured / user a claims history statement regarding the damages registered during the last 5 years of contractual relations or the absence of such damages“.

According to the provisions of Law no. 132/2017, art. 32, par. (9): “At the request of motor vehicle owners, BAAR shall issue within a period of 15 calendar days an attestation of third party civil liability”.

According to the provisions of the Financial Supervisory Authority (ASF) Norm no. 20/2017, art. 17: “RCA or BAAR insurers shall, within 15 days of registration of the request, issue at the request of the insured or users the certificate on the registered damages and include at least the following information:

a) name of the insured;
b) personal identification number / unique identification code of the insured;
c) vehicle data;
d) series and number of MTPL contract;
e) period of validity;
f) bonus-malus class;
g) date of occurrence of the recorded event;
h) the date of payment of the indemnity;
i) damages as a result of injuries to body integrity or health or death, if any;
j) application of the direct settlement clause, if applicable;
k) application of the redemption clause, if applicable".
